그리운 이름, 변희수가 군으로 돌아갑니다

- 변희수 하사 순직 결정 환영 입장문 -

2024. 3. 29. 국방부 중앙전공사상심사위원회가 故변희수 하사의 사망을 ‘순직’으로 결정했습니다. 

 이번 결정은 국가인권위원회가 2023. 1. 31. 자 국방부에 변희수 하사의 순직 재심사를 권고한 처분에 따라 국방부 중앙전공사상심사위원회가 2024. 3. 29. 재심사를 진행하여 변 하사의 사망 구분을 일반사망에서 순직으로 변경한 내용입니다. 

 변 하사가 세상을 떠난 날로부터 3년 1개월, 대전지방법원이 강제 전역을 위법하다고 판시하며 취소한 날로부터 2년 6개월이 지났습니다. 전역처분 취소소송 당시 법원은 강제 전역이 트랜스젠더 차별에 기반한 육군의 위법한 처분임을 분명히 밝혔습니다. 위법한 처분이 한 사람의 소중한 꿈을 무너뜨렸던 것입니다. 그렇기에 변 하사의 죽음은 국가와 군이 책임져 마땅한 일이었습니다. 그 책임을 인정받기까지 너무 길고 아픈 시간을 보냈지만 그립고 애통한 마음으로 뒤늦은 순직 결정에 환영의 뜻을 표합니다.

 국방부와 육군은 패소 이후에도 변 하사의 기일을 제멋대로 정해놓고 순직 심사를 회피해왔고, 대통령 소속 군사망사고진상규명위원회의 순직 인정 권고에도 불구하고 육군 보통전공사상심사위원회는 2022. 12. 1. 변희수 하사를 순직 비해당자로 분류한 바 있습니다. 강제 전역을 결정할 때와 마찬가지로 논리도, 근거도 없었습니다. 잘못을 인정하고 바로 잡을 기회 앞에서조차 비겁했던 우리 군의 부끄러운 모습 역시 오래 기억되어야 할 것입니다.

 순직 결정이 트랜스젠더 군인 변희수의 온전한 명예회복은 아닐 것입니다. 군이 성소수자들에게 안전한 공간이 될 수 있도록, 다시는 이러한 비극이 벌어지지 않도록 남은 숙제를 풀어가겠습니다. 나아가 소수자들이 저마다의 꿈 앞에 좌절하지 않고 함께 살아가는 세상을 바랐던 변 하사의 소중한 바람을 엮어 우리의 삶으로 이어내겠습니다. 

 누구보다 군인임을 자랑스러워했고, 군을 나의 조직으로 굳게 믿었던 변희수 하사. 그녀의 영혼이 맑은 미소로 군으로 돌아가길 바랍니다. 

 모두의 오랜 기억과 다짐으로 다시 한번 고인의 명복을 빕니다.

Welcoming the Ministry of National Defense’s Decision to
Deem the Death of Army Staff Sergeant Byun Huisu in the Line of Duty 

 

As of 29 March 2024, the Central Committee for Examination of Killed or Wounded in Action and Death or Injury in the Line of Duty of the Ministry of National Defense has determined the passing of the late Army Staff Sergeant Byun Huisu as "death in the line of duty."  

This decision follows the recommendation from the National Human Rights Commission of Korea on 31 January 2023, urging the Ministry of National Defense to re-consider SSgt Byun Huisu's posthumous status, leading to the Central Committee for Examination’s re-examination on 29 March 2024, changing her death from ‘ordinary death’ to ‘death in the line of duty’. 

It has been three years and one month since SSgt Byun left us, and two years and six months since the Daejeon District Court ruled the forced discharge as unlawful. During the legal battle, the court unequivocally stated that the forced discharge was a discriminatory act against transgender individuals. It was a decision rooted in injustice that shattered one individual's precious dreams. Therefore, it was incumbent upon the State and the military to acknowledge their responsibility. Although it took an agonizing and long time to receive this acknowledgment, we welcome the belated determination of her posthumous status with a sense of longing and sorrow. 

Even after the legal defeat, the Ministry of National Defense and the Army HQ evaded the assessment of SSgt Byun's posthumous status, arbitrarily determining her date of death. The Army decided that her death is not in the line of duty on 1 December 2022, despite the recommendation for posthumous recognition by the Presidential Truth Commission on Deaths in the Military. There was no logical or evidential basis for this decision; for a long time, we shall remember the shameful behavior of our military that hesitated even when faced with an opportunity to admit mistakes and make amends. 

The determination of posthumous status may not fully restore the honor of Byun Huisu, the first openly transgender soldier. We will continue to work on the remaining tasks to ensure that the military becomes a safe space for LGBTIQA+ individuals so that tragedies like this never recur. Furthermore, we will weave SSgt Byun's cherished aspirations into our lives, aiming for a world where minorities can pursue their dreams without hindrance. 

SSgt Byun Huisu, who took pride in being a soldier more than anyone else and firmly believed in our military as her organization. May her soul return to the military with a pure smile. 

As a testament to everyone's lasting memory and commitment, we once again extend our deepest condolences to the deceased.
